1. Scope & Operator

These Terms of Service ("Terms") govern your use of mpsignalxau.com and all services provided by MP Signal. MP Signal is operated by Ben Kyeremeh, Winterstr 44, 28215 Bremen, Germany (see Impressum). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

MP Signal provides automated market analysis, trading signals, and a live dashboard related to XAUUSD (Gold) trading. Our signals are generated algorithmically by a multi-timeframe analysis system. The Service is provided for informational and educational purposes only.

4. Risk Acknowledgment

• Trading foreign exchange (Forex) and commodities (including XAUUSD/Gold) carries a high level of risk and may not be suitable for all investors.
• You could sustain a loss of some or all of your initial investment and potentially more than your initial investment if trading with leverage.
• Past performance does not guarantee future results. Any performance statistics, win rates, or historical data displayed are derived from backtesting or historical analysis and do not represent actual trading results.
• Hypothetical or simulated performance results have inherent limitations. Unlike actual trading records, simulated results do not represent real trading. No representation is made that any account will achieve profits or losses similar to those shown.

5. Signal Disclaimer

All signals provided by MP Signal are generated algorithmically. They represent the output of a computer model and are:

• Not guaranteed to be accurate, complete, or timely
• Subject to technical failures, data delays, and model errors
• Intended as one input among many to your own independent analysis

Never trade based solely on signals without your own analysis, risk management, and consideration of your financial situation.

6. Subscription Plans & Payment

6.1 Available Plans

MP Signal offers subscription plans as displayed on the pricing/payment page. Plans may include:

• Free Trial: Limited-time access (typically 5 trading days) for evaluation purposes. One trial per person. We reserve the right to deny trial access at our discretion.
• 6-Month Access: Full access to all signals and dashboard for 6 months.
• Lifetime Access: Full access for the lifetime of the Service.

Prices are displayed on the payment page. All prices are in US Dollars (USD) unless otherwise stated.

6.2 Payment Methods

We accept payment via cryptocurrency (details provided at checkout) and may add additional payment methods (credit/debit card, bank transfer) in the future. Payment processing is handled by third-party providers. We do not store full payment instrument details.

6.3 Access Grant

Access to the Service is granted immediately upon payment confirmation. By completing your purchase, you expressly consent to immediate access and acknowledge that your 14-day withdrawal right expires once digital content delivery begins (see § 9 — Right of Withdrawal).

7. Trial Terms

Our free trial provides limited-time access for evaluation:

• The trial period runs for 5 consecutive trading days (Monday through Friday) from the date of activation.
• One free trial per person/household/IP address. Multiple trial accounts will be terminated.
• We reserve the right to modify or discontinue the trial offer at any time.
• At the end of the trial period, access to premium features is automatically suspended unless a paid subscription is purchased.
• No payment information is required to start a trial. You are never charged automatically.

8. No Refund Policy

Due to the digital nature of our Service, all sales are final after the 14-day withdrawal period. Once you have accessed the digital content (signals, dashboard), the Service is considered fully delivered. Refunds are not provided for:

• Trading losses incurred while using our signals
• Dissatisfaction with signal frequency or quality (past performance does not guarantee future results)
• Technical issues on your side (internet connection, device compatibility)
• Change of mind after the withdrawal period has expired

Chargebacks initiated without first contacting us at support@mpsignalxau.com will result in immediate account termination.

9. Right of Withdrawal (Widerrufsrecht)

As a consumer under German law, you have a 14-day right of withdrawal from the date of contract conclusion. However, per § 356(5) BGB, this right expires immediately once we begin delivering the digital content (signals and dashboard access) with your express consent and acknowledgment.

10. User Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree not to share, redistribute, resell, or republish our signals or content without explicit written permission.
• You agree not to use the Service for any unlawful purpose.
• You agree not to attempt to reverse-engineer, decompile, or extract our signal algorithms.
• Account sharing is prohibited. One account = one user. Violations will result in immediate termination without refund.

11. Intellectual Property

All content on the Website and delivered through the Service — including text, graphics, logos, signals, data, algorithms, and software — is the property of MP Signal and protected by applicable intellectual property laws. Unauthorized reproduction, distribution, or commercial use is strictly prohibited.

12. Limitation of Liability

To the fullest extent permitted by German law:

• MP Signal, its operator, and affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service.
• This includes, without limitation: trading losses, lost profits, data loss, or damages resulting from signal errors, service interruptions, or technical failures.
• Our liability for intent and gross negligence remains unaffected. For slight negligence, we are only liable for breach of essential contractual obligations (cardinal duties), limited to foreseeable, typical damages.
• The above limitations do not apply to liability for injury to life, body, or health, or under the German Product Liability Act (Produkthaftungsgesetz).

13. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted or error-free service. We may temporarily suspend the Service for maintenance, updates, or technical reasons without prior notice. We are not liable for downtime or data loss.

14. Third-Party Links

The Website may contain links to third-party websites. MP Signal is not responsible for the content, accuracy, or practices of any linked third-party site. Use of third-party services is at your own risk.

15. Account Termination

We reserve the right to suspend or terminate your account without refund if you violate these Terms, engage in fraudulent activity, or abuse the Service (including but not limited to: account sharing, signal redistribution, harassment of staff, or chargeback fraud).

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to registered users via email. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must discontinue use of the Service.

17. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For contracts with consumers, this choice of law applies only to the extent that it does not deprive the consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence.

The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Bremen, Germany, insofar as you are a merchant (Kaufmann), a legal entity under public law, or a special fund under public law. For consumers, the statutory place of jurisdiction applies.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely approximates the economic purpose of the invalid provision.
